Website Terms of Service: Dispute Resolution & Legal Notice Clause

1. Governing Law and Jurisdiction

2. Mandatory Informal Dispute Resolution

Before filing any formal legal claim or arbitration, you and GreyMantle Co. agree to try to resolve the dispute informally.

  • The Notice: You must send a written "Notice of Dispute" to hello@greymantle.co or by certified mail to 1029 S. Jackson St. Apt 721, Seattle, WA. 98104.
  • Content: The Notice must describe the facts of the dispute and the specific relief you are seeking.
  • The Window: Both parties agree to spend thirty (30) days from the receipt of the Notice attempting to settle the matter through good-faith negotiation before taking further steps.

3. Binding Arbitration

If the dispute cannot be resolved within thirty (30) days through informal negotiation, you and [Company Name] agree that the dispute will be settled exclusively through binding arbitration, rather than in a court of law.

  • Provider: The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
  • Location: The arbitration hearing will take place in King County, Washington, or via remote video conference if mutually agreed.
  • Exceptions: Either party may still bring individual claims in small claims court if the claim qualifies and remains in that court.

4. Class Action and Jury Trial Waiver

YOU AND [COMPANY NAME] AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You explicitly waive your right to a trial by jury or to participate as a plaintiff or class member in any class-action lawsuit.

5. How Formal Notices Are Handled

All formal notices required under these Terms must be in writing

  • To Us: Sent via email to hello@greymantle.co or via certified mail to 1029 SJackson St. Apt 721, Seattle, WA. 98104. Delivery is effective upon manual or automated receipt confirmation (for email) or three (3) business days after mailing (for physical mail).
  • To You: Sent to the email address tied to your account or posted publicly on this Website. Delivery is effective 24 hours after emailing or immediately upon posting to the Website.
